I am aware that participation in the Youth Sailing & Racing School (“the School”) of the National Yacht Club (“the Club”), and the use of the Club’s premises and facilities may involve certain risks, dangers, and hazards, including property damage, bodily injury or death (“Loss”), arising from a variety of causes, including but not limited to boating, boarding and disembarking from boats, walking on or falling from docks, decks, patios and stairs, failure or misuse of equipment, engaging in volunteer activities, and negligence of the Club or its staff, its members, other users of watercraft, or persons participating the activities and using the facilities of the Club, and myself. On behalf of myself and the Participant, I freely accept and fully assume all such risks, dangers, and hazards and the possibility of Loss, resulting therefrom. IN CONSIDERATION of the Club providing the Participant with access to its activities, and use of its facilities, I hereby agree as parent or legal guardian of the Participant TO WAIVE ANY AND ALL CLAIMS that the Participant or I have or may in the future have against the Club, its directors, officers, members, employees, agents, representatives and volunteers (“the Releasees”), and, TO RELEASE the Releasees from any and all liability for any Loss that the Participant may suffer, or that I or the Participant’s next of kin may suffer, as a result of the Participant’s participation in the activities or presence upon the facilities of the Club, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care. This Agreement shall be effective and binding upon the Participant’s heirs, next of kin, executors and administrators, assigns and representatives in the event of his or her death or incapacity. In entering into this Agreement, I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this Agreement. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I MAY HAVE AND WHICH THE PARTICIPANT MAY HAVE, INCLUDING THE RIGHT TO RECOVER OF DAMAGES IN A COURT ACTION AGAINST THE RELEASEES. Students must wear a Canadian Coast Guard approved lifejacket at all times while in the boat, abide by the rules, and co-operate with the instructors or risk expulsion. CANCELLATION/REFUND POLICY: Students will be registered upon receipt of a registration form accompanied by full payment. Registrations may be cancelled and refunded less a $100.00 service charge if written notice of cancellation is received 30 days prior to the start of course. No refunds for days missed. PROGRAM HOURS POLICY: NYC Sailing & Racing School’s drop-off hours are between 8:45-9:00 AM and pick-up hours are between 4:00 - 4:15 PM. You may opt-in to the Extended Hours program from 8:00 AM - 5:00 PM (above) or allow your child to self-sign out (participant must leave Club property). If parent/guardian/designated person is late for pick-up a $15 fee will be charged for the first 10 minutes and $1 per minute thereafter. PERMISSION TO LEAVE PROPERTY: I give my permission for my child to leave the property at National Yacht Club to play games at the park or sail to the beach on Toronto Island etc. Leaving the property is part of the program and it is my understanding that my child will not always be on the grounds at National Yacht Club, 1 Stadium Rd. CONCUSSION POLICY: All participants and their parents/guardians are asked to review NYC Sailing & Racing School’s Concussion Policy available online at - https://thenyc.com/Learn_to_Sail/Concussion_Policy_-_Rowan_s_Law. It is important that all participants read and understand what can be done to prevent concussions, recognize the signs and symptoms of a concussion and review our removal/return-to-sport policy regarding concussions. Recognizing the potential seriousness of a concussion, I commit to following National Yacht Club’s concussion related protocols and expectations.
